Please take a few minutes to review the Folloze Community Terms of Service. In these Community Terms of Service, Folloze may be referred to as “we” or “us,” and a user shall be referred to as "you” or “your.”

Applicable Laws

Your contributions or actions in the Folloze Community (“Community”) may not violate any laws or ethical standards.

Your Content

Once you post your content (“User Content”), it becomes public and can be viewed by us and any users of the Community, and we are not responsible for keeping it confidential.  You may not discuss any moderation of your account in public.

Acceptable Use

You are solely responsible for the User Content that you post or transmit and you agree not to post, transmit or otherwise publish through the Community any of the following:

• User Content that is unlawful, defamatory, hateful, harassing, threatening, invasive of privacy or publicity rights, abusive, inflammatory, fraudulent or otherwise objectionable or harmful;

• User Content that is obscene, pornographic, indecent, lewd, sexually suggestive, including without limitation photos, videos or other User Content containing nudity, unless you have restricted access to such User Content with an appropriate content filter setting that will restrict viewing by minors;

• User Content that would constitute, encourage or provide instructions for a criminal offense, violate the rights of any party, endanger national security, or that would otherwise create liability or violate any local, state, national or international law;

• User Content that may infringe or violate any patent, trademark, trade secret, copyright or other intellectual or other proprietary right of any party; User Content that impersonates any person or entity or otherwise misrepresents your affiliation with a person or entity;

• unsolicited messages containing promotions, political campaigning, advertising or solicitations;

• private information of any third party, including, without limitation: addresses, phone numbers, email addresses, social security numbers and credit card numbers;

• viruses, corrupted data or other harmful, disruptive or destructive files; and

• User Content that is objectionable, harmful or which restricts or inhibits any other person from using or enjoying the Services, or which may expose Flickr or its users to any harm or liability of any nature, or which is legally required to be deleted or made private.

Although we prohibit certain activities in these Terms of Service, Folloze does not make any representation or warranty that the User Content you may encounter through your use of the Community complies with these acceptable use provisions or the Terms of Service. YOUR USE OF THE SERVICES IS SOLELY AT YOUR OWN RISK.

Reservation of Rights

Folloze reserves the right to change or remove User Content or to restrict access to individual users, for any reason, with or without notice to you. We may delete your account, passwords and/or User Content. You understand that we may also continue to make your User Content available through the Community, or elsewhere as permitted under these Terms of Service, even if your use of the Community is suspended or terminated.

Updates

We reserve the right to update these Terms of Service anytime.  Please check back regularly for the most updated version which will be applicable to you.

Multiple Accounts Prohibited

You are  not permitted to establish multiple accounts in the Community.  If Folloze detects secondary accounts, they will be deleted.

No Warranties by Folloze

All users in the Community are here to help.  However, Folloze shall not be responsible for any consequences resulting from the User Content (including reliability, accuracy or legality) or activities in the Community.  FOLLOZE DISCLAIMS ANY AND ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR PURPOSE.

Feedback 

If you provide any suggestions, comments, improvements, information, ideas or other feedback for enhancements, improvements, features, functionality or other recommendations (collectively, “Feedback”), Folloze is free to retain, use and incorporate such Feedback in its products and/or services, without payment of royalties or other consideration to you.  Accordingly, you hereby grant Folloze a worldwide, perpetual, non-revocable, sublicensable, royalty-free right and license to use, copy, disclose, license, distribute and exploit any Feedback without any obligation, payment, or restriction based on intellectual property rights or otherwise.

Limitation of Liability

IN NO EVENT WILL FOLLOZE BE LIABLE TO ANY PERSON OR ENTITY WHATSOEVER FOR ANY LOSS, DAMAGE, INJURY, CLAIM, LIABILITY OR OTHER CAUSE WHATSOEVER (INCLUDING, WITHOUT LIMITATION, INDIRECT, SPECIAL, INCIDENTAL, EXEMPLARY, PUNITIVE AND CONSEQUENTIAL DAMAGES, LOST PROFITS, LOST DATA OR BUSINESS INTERRUPTION) RESULTING FROM THE USE OR INABILITY TO USE THE COMMUNITY AND/OR THE MATERIALS ASSOCIATED WITH THE COMMUNITY, OR RESULTING FROM ANY INFORMATION OR OPINIONS PROVIDED ON OR THROUGH THE COMMUNITY, WHETHER BASED ON WARRANTY, CONTRACT, TORT OR ANY OTHER LEGAL THEORY.

Indemnification

You will defend, indemnify, and hold us harmless from and against any claim by a third party arising from or related to: (a) your use or attempted use of the Community in violation of these Terms of Service, (b) your violation of any law or rights of any third party, or (c) any submissions or User Content you post to the Community, including without limitation any claim of infringement, misappropriation, or violation of any intellectual property, privacy, or other rights.

Your acceptance

BY INDICATING YOUR ACCEPTANCE OF THESE FOLLOZE COMMUNITY TERMS OF SERVICE OR ACCESSING OR PARTICIPATING IN THE COMMUNITY, YOU ARE AGREEING TO BE BOUND BY ALL TERMS, CONDITIONS, AND NOTICES CONTAINED OR REFERENCED HEREIN. IF YOU DO NOT AGREE TO THESE TERMS OF SERVICE, YOU MAY NOT PARTICIPATE IN THE COMMUNITY.
